FWC just pulled into my property and wrote my kid a ticket. ( I wasn’t here) “Failure to report alligator harvest ONLINE” within 24 hours. Complete 100% bullshit. Paper forms were filled out, readily available and offered to her. She didn’t even want to look at them. There is no such law. I will be making some phone calls tomorrow. Way to encourage the next generation FWC! Bunch of freaking idiots.
We follow the law around here, my boys follow the LAW. They have been raised to do things properly, and they do. Tough to swallow a young ignorant chick (with a badge) fucking with me/ and mine. Rant over for now.

Been several years since I hunted gators and wasn't aware you had to report within 24hrs. However, after a little research it appears the rules have changed to require it. Reporting Link: myfwc.com/wildlifehabitats/wildlife/alligator/harvest/ F.A.C. Rule 68A-25.042 Regulations Governing Statewide Alligator Trapping, Permitting, Taking and Sale, cont. (3),(h) An alligator harvest report form (FWC form 1001AT, effective April 30, 2000) provided by the Commission shall be completed by the permittee within 24 hours of taking each alligator and prior to the transfer of the carcass to another person. The permittee shall submit a legible copy of the alligator harvest report form to the Commission for receipt no later than 14 days after the expiration date of the harvest permit. The rule language is somewhat confusing as it mentions submitting w/in 24 hours, but then goes on to say no later than 14 days after permit expiration. Regardless, the officer should have used some discretion with a kid and just educated them. Hopefully you can get the citation dropped.

I’m all for game laws and protecting the resource but how does a 24 hour mandatory reporting rule do anything to conserve wildlife? Are we just expected to bow down and let the man know as soon as we take one of the king’s gators? Give me a break. FWC if your reading this post, you need realize you work for the people not the other way around

If the warden showed up and you had a cites tag in the hide and a filled out form, I would have thought you’d be good, no matter when the gator was killed?

Look at it as a good learning experience for your kid. He gets to argue his case before the judge and explain his interpretation of the law as it is written (assuming the above is the latest version). The two most likely outcomes are the judge rules in your son's favor or he lets him off with a warning and dismisses the case.

It’s definitely clear as mud. My interpretation has always been that you needed to report it online within 24 hours or have a paper copy filled out, also within 24 hrs, with the hard copy sent to the FWC after. If the warden showed up and you had a cites tag in the hide and a filled out form, I would have thought you’d be good, no matter when the gator was killed? After re-reading the rule, I agree with your interpretation that just the form has to be completed within 24 hrs, but doesn't necessarily have to be submitted at that time, just within 14 days of permit expiration. So if the paper form was completed and the cites tag was attached to the gator, the citation should get thrown out. Hopefully when you speak to an FWC LE supervisor they will throw it out without the need to go before a judge.

I know with reporting deer kills we also had a phone number we could call to talk to a real person. The biggest requirement is to get it logged and obtaining a Confirmation number. However, I’m not a gator hunter and don’t know the reporting requirements. I do believe all required game reporting should be exactly the same. I use the electronic app, have the phone number to Tally and could do a paper app before moving the critter if all else fails. Good luck!

He explained the error she had made, he sent her pictures of the instructions on the permit, the harvest report form and a copy of the rule. She still doubled down and said "see you in court". He then got the # of her lieutenant and called him directly.(he was off duty but was kind enough to hear him out) 10 minutes later he called back, instructed Cody to shred the ticket and apologized for his officer. Officer Williams probably isn't having a very good afternoon.(I hope)
Like cad said, a good learning experience for him.

The old state GFC used to be a friend of the sportsman but has morphed into what we have today; Suspicious, accusatory, and overzealous denizens of a law enforcement arm that used to act more like a partner... More like the Feds now.

Before shredding the ticket, it should have an appearance date on it. Call the clerk of court a week before that date and be sure your son isn't on the court schedule.

I've found the last couple encounters with FWC - males mostly, to be less than desirable. They don't know the rules and refuse to look at the rules when you present those to correct them.

There may be more to this story. Original charges are confirmed to have been dropped. Some retaliation ( including surveillance) seems to be going on. I won’t say more until it happens again.
