Good decision by the court. I thought the primary reason bump sticks were invented was to assist those with certain handicaps that had limited hand mobility.
I would disagree they are worthless to those people.
But congress should act if they wish to regulate them in some fashion, not the ATF and the President.
Cad that's the pistol brace, which the 5th district Court invalidated. On grounds that it violated Administrative Procedures Act, and it did. I saw and read both the Proposed Rule and the published rule. They were totally diffrent.
Proposed rule had a discussion an worksheet system that scored point values, that was deleted in entirety from published rule to be replaced with factors that atf could only decide, no one else.
The case was brought by disabled veterans. It was a good ruling as well.
But it is in circuit Court of Texas. I posted a thread/link or ruling in another thread/post.
Bump stocks was a Trump over reach to have atf try to redefine definition in us code laws of machine gun , which is multiple projectiles per a single action of trigger.
Bump stocks don't work that way. The finger moves off the trigger then back on by firing recoil. So still a single projectile for a single action of trigger. I projectile per trigger pull.
Other types triggers are also involved under this. Forced reset and binary.
They expel a projectile when pulled, and another when released. But both are single action of trigger. They were not specifically mentioned I don't believe, but would fall under same thought process.
I heard the oral arguments were convoluted and not well described, (one post on another forum that keeps up with it, I haven't checked others so put it in the believe all of it, part of it, or none of it stack) as far as projectile for a single action of trigger. and Sotomayor dissented based on "if it looks like a duck, squalks like a duck, flys like a duck and roosts like a duck it IS a duck" mindset or something very similar. Her dissent is not suprising,
A machine gun continues to fire projectiles as long as trigger is pressed (single action of trigger- press and hold)
(As usual, for educational purposes only, unless the contrary can be shown, etc..)
